Your Tax Dollars At Work . . . For A Sex Change Operation . . . For A Murderer!

Tax dollars wasted. A jailed murderer. A federal lawsuit. Another federal lawsuit. A flip-flopping judge. A sex change operation?

No, not a trashy television movie. Not a serial or soap opera. Not an outrageous crime drama. Not even A Jerry Springer episode.

As reported by the Associated Press via Bobby Eberle of GOPUSA.com, Robert Kosilek was convicted in 1990 of murdering his wife in Massachusetts. But in 2000 he decided he suffered from “gender-identity disorder” and sued the Massachusetts Department of Corrections for “treatment” (i.e., a sex change operation). Two years later U.S. District Court Judge Mark Wolf ruled that Kosilek was entitled to treatment, but refused to order an operation. But Kosilek had been taking hormone injections and lives as a woman in an all-male prison. He sued again in 2005, arguing that the operation was a “medical necessity.” This time, Judge Wolf agreed. From the AP:

In his ruling Tuesday, Wolf found that surgery is the “only adequate treatment” for Kosilek’s “serious medical need.”

“The court finds that there is no less intrusive means to correct the prolonged violation of Kosilek’s Eighth Amendment right to adequate medical care,” Wolf wrote in his 126-page ruling. 

According to the Boston Globe, Judge Wolf wrote in his opinion:

This fact that sex reassignment surgery is for some people medically necessary has recently become more widely recognized.

As Eberle points out, Judge Wolf hasn’t made a legal decision, he’s indulged a murderer. Kosilek may be sick and need and need medical attention, but not the type Judge Wolf has ordered. We, unfortunately, have become accustomed to judges finding “rights” that are not enumerated in the constitution. But a sex change? In the Bill of Rights? Taxpayer funded? Please tell me where the words “sex” or “reassignment” or “surgery” are anywhere in the constitution.

But is this shocking to anyone? While it should be, it isn’t a surprise to me. In an age when, according to the Left, anything passes as “medical” and “necessity” and as a “right” (abortion on demand, contraception), and that it all should be “free” (Obamacare), and therefore taxpayers must foot the bill, there is no need to ask where to draw the line. It’s already been drawn . . . and the picture isn’t pretty.

Not a pretty sight. Robert Kosilek as “Michelle” in prison. A federal judge as ordered that taxpayers fund his sex-change operation. Not a pretty decision, either.

    PARDON, but shouldn’t persons in state custody receive the same standard of medical care as others in society?

    The standard of care for gender related health concerns should apply to persons in state custody as they would apply to others in society.

    That is a rational, moral point of view.

    And, by the way, that is the view of Jesus Christ, who advised that those who fail to care for those in prison have failed to care for the Son of God.

    Is that not so?

    As a taxpayer of Ma I object to the surgery.
    When one is convicted of a crime, one gives up his rights to live as a
    Citizen who follows the rules of mankind. If the state has all this extra
    money, it should be applied to a worthy cause. This is not a life health
    problem, it goes against nature and God. In no way does denying this operation rise to the level of ‘cruel and unusual punishment’.
    If the murdering Kosilek felt this way, he should have had surgery when married and not killed his wife. We Citizens in Ma should have a say in this.
