Today We Sued the State Over “Trasngender” Policies in Virginia Schools
Today, we officially filed a lawsuit to stop the VA Department of Education (VDOE) from forcing radical and far-reaching “transgender” policies into every facet of every K-12 public school in Virginia. In order to protect the fundamental rights of students, parents, and teachers, and to uphold the rule of law from bureaucrats who flagrantly ignore it, we really had no choice but to fight them in court.

With the lead of our new legal arm, Founding Freedoms Law Center (FFLC), representing itself, along with The Family Foundation, and Sarah Via, a brave mother of children in Hanover public schools, we launched an “administrative appeal” to hopefully halt the implementation of VDOE's new “Model Policies for the Treatment of Transgender Students in Virginia’s Public Schools” (Model Policies) that were created for the purpose of requiring every school board in Virginia to adopt them. After putting these on hold, we are asking the court to send this “guidance document” back to VDOE to correct the legal errors it made when adopting them and to remove the numerous constitutional violations created by these Model Policies.
In addition to ignoring our legal objections during the public comment process (which they are required by law to specifically address), these Model Policies trample all over fundamental rights, including free speech, religious exercise, bodily privacy, due process, equal protection, and parental rights. We also sent a letter to every school district across the state informing them of our lawsuit and urging them to withhold from taking any action on these policies until the legal issues are worked through. We’d prefer not to have to fight this battle in every single locality right now, but we will if it comes to that. For now, we are doing everything we can to head this off and force the VDOE back to the drawing board to craft policies that respect ALL students, parents, and teachers – not just a select favored few.
